The appeal is a direct challenge to the Court's 2000 Stenberg v. Carhart decision invalidating a state PBA ban on grounds that it did not include an exception for the health of the mother. Stenberg split the Court 5-4, with Sandra Day O'Connor concurring with the majority. Thus, Samuel Alito will have an early opportunity to change the constitutional law governing abortion, and probably will. "
